By signing into the City of New York's DDC Anywhere portal and any of its online systems (hereinafter referred to collectively as the "Portal"), you agree to abide by the terms and conditions of the City of New York's Cloud Use Policy and the policies of DDC, including but not limited to: 1) Any and all data that you access on the Portal is the property of the City of New York; 2) You consent to the disclosure of any information and/or the content of files you enter into the Portal; 3) All users of the Portal are responsible for ensuring that they act in accordance with all of the policies, rules, laws and legislation applicable to the City of New York and its systems and data; 4) Users acknowledge and agree that the City of New York, acting by and through DDC, is the sole and exclusive owner of the information and records on the Portal and all applicable rights to such information, including without limitation, all rights in connection with patents, copyrights, trademarks and/or trade secrets or other proprietary information, as applicable; 5) Users of the Portal also agree to hold all information confidential and to restrict access that is not specifically authorized in writing by DDC; 6) Users of the Portal may not directly or indirectly disclose, distribute, publish, reproduce, transfer or otherwise make any information and/or records on the Portal available to others without the advance written permission of DDC; and 7) Users of the Portal agree to defend, indemnify and hold harmless the City for any losses, damages, liabilities, costs or claims suffered as a result of any breach these terms, including any reasonable fees incurred by the City.
